These Terms and Conditions ("Terms") govern your use of the website located at tradiesnappty.site ("Site"), the Tradiesnap mobile application ("App"), and any platform services provided by Tradiesnap Pty Ltd (ABN 84 696 926 244 / ACN 696 926 244) ("Tradiesnap", "we", "us", or "our").
By accessing our Site, using our App, or registering for our platform, you ("you" or "User") agree to be bound by these Terms. If you do not agree, please do not use our platform or services.
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia, including but not limited to the Competition and Consumer Act 2010 (Cth) (incorporating the Australian Consumer Law), the Privacy Act 1988 (Cth), and the Spam Act 2003 (Cth).
Tradiesnap operates a digital platform that connects tradespeople ("Tradies") with clients ("Clients") seeking trade services. The platform provides tools for job matching, quoting, scheduling, invoicing, payment processing, and reputation management.
Tradiesnap is a platform provider only. We do not perform trade work and are not a party to any agreement between Tradies and Clients. Tradies are independent operators and are solely responsible for the quality, legality, and safety of the services they provide.
To use certain features of the platform, you must create an account. You agree to:
Tradies must provide a valid ABN and, where applicable, relevant trade licence details. We may verify this information with the Australian Business Register and relevant state licensing authorities. Failure to provide accurate information may result in account suspension or termination.
You may access and use the platform for lawful personal or business purposes in accordance with these Terms. You must not:
Tradiesnap offers subscription plans for Tradies. Fees, billing cycles, and plan features are described on our pricing page and may change from time to time with reasonable notice.
All intellectual property rights in the platform — including text, graphics, logos, software, and the Tradiesnap name and brand — are owned by or licensed to Tradiesnap Pty Ltd. Nothing in these Terms grants you any right to use our intellectual property other than as permitted herein.
By posting content on the platform (including profile information, portfolio images, and reviews), you grant Tradiesnap a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content for the purposes of operating the platform.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (ACL) (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot be lawfully excluded or limited.
Where our services are supplied to a consumer under the ACL, you may have consumer guarantees including that services are provided with due care and skill and are fit for purpose.
To the extent permitted by law, our liability for a breach of a non-excludable consumer guarantee is limited (at our election) to:
Tradiesnap does not guarantee the quality, safety, legality, or timeliness of any trade services performed by Tradies on the platform. We do not endorse or warrant any particular Tradie. Clients should independently verify licences, insurance, and qualifications before engaging a Tradie.
The platform is provided "as is" and "as available". While we endeavour to maintain uninterrupted service, we do not guarantee that the platform will be error-free or available at all times.
Subject to clause 8 and to the fullest extent permitted by law:
You agree to indemnify, defend, and hold harmless Tradiesnap Pty Ltd, its directors, officers, employees, and agents from any claims, losses, damages, costs, or expenses (including reasonable legal fees) arising from:

Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
We may update these Terms at any time by publishing the revised version on our Site. The revised Terms will be effective from the date of publication. Continued use of the platform after changes are published constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
Failure by Tradiesnap to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
These Terms, together with our Privacy Policy and any applicable subscription agreement, constitute the entire agreement between you and Tradiesnap Pty Ltd with respect to your use of the platform, superseding all prior agreements, representations, and understandings.
These Terms are governed by and construed in accordance with the laws of Western Australia and the Commonwealth of Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Western Australia (and any relevant appellate courts) for the resolution of any disputes arising under or in connection with these Terms.
